MAJOR DISRUPTIVE EVENTS POLICY

1. INTRODUCTION

1.1. Purpose: This Major Disruptive Events Policy ("Policy") explains how cancellations and refunds are handled when unforeseen, large-scale events beyond the control of Members or Partners arise after a reservation is confirmed, making it impossible or illegal to complete the reservation for a Space or unit (e.g., seat, desk).

1.2. Precedence: When this Policy applies to a reservation, its terms take precedence over the standard Cancellation and Refund Policy and the Partner's chosen cancellation policy for that specific reservation.

1.3. Relation to Other Terms: This Policy is part of, and should be read in conjunction with, our main Terms of Service and Payments Terms of Service. All capitalized terms used but not defined herein shall have the meanings given to them in the Terms of Service.

1.4. Not Insurance: This Policy is not an insurance policy and does not replace any travel or business insurance Members or Partners may have.

2. QUALIFYING MAJOR DISRUPTIVE EVENTS

2.1. Applicability: This policy applies only to confirmed reservations directly impacted by a "Major Disruptive Event" that occurs after the reservation was made.

2.2. Definition: A Major Disruptive Event refers to unforeseen, large-scale situations impacting the location of the reserved Space or the ability to legally access/use it. Examples include, but are not limited to:

  • Declared public health emergencies and epidemics/pandemics: Government-declared emergencies, epidemics, or pandemics resulting in official restrictions (e.g., lockdowns, mandatory closures, travel bans) directly preventing access to or use of the reserved Space. (Note: This does not include endemic diseases like the flu).

  • Government travel restrictions: Mandatory travel restrictions imposed by a governmental agency (e.g., evacuation orders, curfews, travel bans) that directly prevent or prohibit travelling to or utilizing the reserved Space during the reservation period. (Note: This does not include non-binding travel advisories).

  • Military actions and other hostilities: Acts of war, hostilities, invasions, civil war, terrorism, explosions, bombings, rebellions, riots, insurrection, civil disorder, and civil unrest directly impacting the safety or accessibility of the reservation location.

  • Natural disasters: Large-scale natural disasters such as earthquakes, volcanic eruptions, tsunamis, tornadoes, cyclones, hurricanes, floods, wildfires, or other severe and abnormal weather events that directly impact the location of the Space, making it unsafe or inaccessible, or resulting in official evacuation orders.

  • Large-scale outages of essential utilities: Prolonged, widespread interruptions of essential utilities like electricity, water, or internet (where internet access is a core advertised feature of the Space) affecting the vast majority of the area where the Space is located, rendering the Space unusable for its intended purpose during the reservation period.

  • Changes to government obligations: Unexpected changes in visa or permit requirements imposed by a governmental authority after the reservation was made that prevent the Member from legally travelling to or using the Space for the reservation.

2.3. Exclusions: This policy generally does not apply to:

  • Events where the impact on the reservation was known, foreseeable, or disclosed at the time of reservation.

  • Personal or unexpected circumstances affecting only the individual Member or Partner (e.g., illness or injury not related to a declared public health emergency, individual transportation issues like flight cancellations or car trouble not caused by a covered Event, personal or business scheduling conflicts, jury duty, non-emergency maintenance). These situations are typically governed by the standard Cancellation and Refund Policy.

  • Weather or natural conditions that are common enough to be foreseeable in a particular location (e.g., typical monsoon rains, seasonal heatwaves, predictable heavy traffic) unless they escalate to the level of a qualifying event under Section 2.2 (e.g., resulting in official evacuation orders, large-scale utility outages).

  • Cancellation or rescheduling of personal events for which the Space reservation was made.

  • Government guidance or advisories that fall short of mandatory restrictions or prohibitions.

3. CANCELLATIONS UNDER THIS POLICY

3.1. Initiating Cancellation: If a Member or Partner believes a confirmed reservation is directly impacted by a qualifying Major Disruptive Event, they should contact Tranity support (www.tranity.in/support) as soon as possible, ideally before the reservation start time if feasible.

3.2. Assessment & Evidence: Tranity will assess the situation based on available information. We may require verifiable evidence of the Major Disruptive Event and its direct impact on the ability to complete the reservation (e.g., links to official government orders, news reports, photographic evidence of impact on the Space or surrounding area).

3.3. Tranity's Determination: Tranity will review the circumstances and evidence provided and determine, in its reasonable discretion, whether the Major Disruptive Event qualifies under this policy and directly prevents or legally prohibits the reservation from proceeding as planned. We will communicate our decision to both the Member and the Partner.

4. CONSEQUENCES OF CANCELLATION UNDER THIS POLICY

4.1. If Tranity Determines the Policy Applies:

Member:

The Member will receive a full refund of the Total Fees paid for the reservation (including Listing Fee, Tranity Service Fee, and associated GST), processed by Tranity Payments.

Partner:

  • The Partner will not receive a Payout for the cancelled reservation period (See Payments Terms of Service for general Payout conditions and definitions).

  • Tranity will typically waive any cancellation fees or penalties that would normally apply to a Partner-initiated cancellation under the standard Cancellation and Refund Policy.

  • The cancellation under this policy will generally not negatively impact the Partner's account standing or listing visibility in relation to cancellation metrics.

4.2. Assistance To Member: While not obligated, Tranity may, where feasible and requested, assist Members in finding alternative Spaces listed on the Platform.

5. RELATIONSHIP TO OTHER POLICIES

5.1. This policy overrides the Partner's selected cancellation policy and the standard refund rules outlined in the Cancellation and Refund Policy only when Tranity determines that a qualifying Major Disruptive Event directly impacts and prevents or legally prohibits the completion of a confirmed reservation.

5.2. In all other situations not covered by this policy, the Partner's chosen cancellation policy and the standard Cancellation and Refund Policy will apply.

5.3. All other aspects of the reservation and use of the Services remain governed by the Terms of Service, Payments Terms of Service, Privacy Policy, and other applicable policies.

6. POLICY MODIFICATIONS

We reserve the right to modify this Major Disruptive Events Policy at any time in accordance with the modification clause in our main Terms of Service.
